TERMS OF SALE

These terms explain how quotes, payment, custom orders, website projects, cancellations, delivery and collection work with DLB Computer Services.

1. About these terms

These terms apply when you ask DLB Computer Services ("DLB", "we", "us") to supply a custom PC, component, repair, upgrade, website project or related service. Your accepted quote, invoice and any written variations form part of the agreement. If they conflict with these terms, the specific written terms on your accepted quote take priority.

Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including the consumer guarantees under the Australian Consumer Law.

2. Quotes and orders

A LiveBuild request is a request for a quote and is not an order. A quote is valid for the period stated on it and may change before acceptance if component price or availability changes. Your order is accepted when you accept the final configuration and we confirm receipt of the full upfront payment, unless a different arrangement is stated on your quote.

You are responsible for checking that the name, contact details, delivery details, configuration and intended use shown on the quote are correct. Tell us about any required software, connectivity, size, performance or compatibility requirement before accepting the quote.

3. Payment for goods and computer work

DLB Computer Services is not registered for GST and does not charge GST. The amount shown on your accepted quote is the amount payable, subject to any changes you approve.

  • For custom PCs, components, repairs and computer work, unless your quote says otherwise, the full quoted amount must be paid in cleared funds before we order parts or begin work.
  • Payment is applied to your order; it is not an additional fee.
  • We will not purchase components until you have approved the final written configuration and price.
  • If you approve a variation that increases the price, the additional amount is payable before we order the changed parts or perform the additional work.
  • If an approved variation reduces the price, we will refund or credit the difference.
  • Online card payments may be processed by Square or another payment provider identified at checkout.

4. Changes and component availability

Changes requested after acceptance may affect price and timing. We will obtain your approval before making a material paid change. If an agreed component becomes unavailable, we may offer an equivalent or better alternative. You can accept the alternative, wait for the original part, revise the order, or cancel the affected part of the order and receive a refund for amounts paid for that part.

5. Cancellation and change of mind

If you cancel before we order parts or begin paid work, we will refund the full amount paid. If you cancel later, we will refund the amount paid less reasonable costs that we have already incurred and cannot recover, such as supplier cancellation fees, return freight, restocking fees, specially ordered parts and work already completed. We will explain those costs and provide the balance of any refund.

Because custom PCs are sourced and built to an agreed specification, we do not accept returns or exchanges and do not provide refunds because you change your mind after parts have been ordered or work has begun. This includes deciding that you no longer want the build, finding a lower price elsewhere, or preferring a different component after approving the final configuration. The cancellation terms above still apply before parts are ordered or work begins.

This change-of-mind policy does not affect your rights where goods or services fail to meet a consumer guarantee under the Australian Consumer Law. If we cancel an order for reasons within our control, we will refund the affected amounts paid unless you accept another arrangement.

6. Build timing

Any build or delivery date is an estimate unless we expressly agree to a fixed date in writing. Timing can be affected by component availability, supplier delays, testing or an approved change. We will keep you informed of material delays. Where no time is agreed, services will be supplied within a reasonable time as required by law.

7. Collection and delivery

Collection

Collection is by appointment from the location confirmed in your order. Please bring suitable identification or arrange an authorised collector with us beforehand. We may demonstrate the system and ask you to confirm receipt at handover.

Delivery

Available delivery methods, charges and any insurance will be shown on the quote or agreed before dispatch. You must provide a complete address and a safe way to receive the order. Additional delivery attempts or storage caused by an incorrect address or missed appointment may incur reasonable costs disclosed to you first.

Ownership passes after full payment. Responsibility for accidental loss or damage passes when you or your authorised recipient takes possession, subject always to rights that apply under Australian law and any carrier arrangement we make for you.

8. Customer-supplied equipment and data

Tell us about known faults, passwords needed for agreed work, and any data that must be protected. Back up important data before providing equipment for repair or upgrade. We will take reasonable care, but repair work can involve testing, resetting or replacing storage devices. We will provide any repair notice required by the Australian Consumer Law before accepting goods for repair.

9. Problems, returns and refunds

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Our Warranty & Refundspage explains how to report a problem and the remedies available for major and minor failures. We may assess the product before providing a remedy. Proof of purchase can include a DLB Computer Services invoice, receipt or LiveBuild record.

10. Website design projects

Scope, content and approvals

The accepted written quote identifies the pages, features, deliverables, revision allowance, price and payment schedule included in a website project. Requests outside that scope are variations and will only proceed after we explain any effect on price or timing and you approve it.

You must provide requested text, images, branding, access details and feedback within a reasonable time. You confirm that you have permission to use material you provide. Project dates may move when required material, access or approval is delayed. We will ask you to review the website before launch and report corrections against the agreed scope.

Website payments and cancellation

The payment amount or stages required before work begins will be stated on the quote. If you cancel, we will refund amounts paid less the reasonable value of work already completed and reasonable third-party costs that we committed with your approval and cannot recover. We will explain those deductions. If we cancel for reasons within our control, we will refund the amount paid for work not supplied unless you accept another arrangement.

Domains, hosting and third-party services

Domain registration, hosting, email, payment processing, stock media, plugins and other third-party services are only included when the quote says so. Their providers may charge recurring fees and apply their own terms. Where practical, customer accounts and domains will be registered in your name or transferred to your control. You are responsible for renewals after handover unless an ongoing care plan says otherwise.

Ownership and handover

You retain ownership of material you supply. Unless the quote says otherwise, after full payment you own the final bespoke website files that we create for your project. DLB retains ownership of its pre-existing tools, reusable methods and general know-how, and third-party material remains subject to its licence. We grant the rights reasonably needed to use those elements as part of the completed website.

Care after launch

Ongoing updates, hosting, backups, security monitoring, content changes and support are not included after handover unless they appear in the quote or a separate care plan. This does not limit any rights or remedies available under the Australian Consumer Law if our services fail to meet an applicable consumer guarantee.

11. Resolving concerns

Contact us promptly using the contact details on your quote, invoice or DLB Computer Services correspondence. Include your LiveBuild reference and a clear description of the issue. We will review the matter and work with you on an appropriate outcome. These terms are governed by the laws of Western Australia and the applicable laws of Australia.
